General conditions of use of the platform

I. Terre dei Malaspina

Terre dei Malaspina is a platform (hereinafter the “Platform”) that allows you to search for and book Experiences such as entrance tickets, guided tours, itineraries, festivals, conferences, workshops, courses, events, services, etc. (hereinafter the “Experiences”) within the Terre dei Malaspina area (hereinafter the “Locations”).
The services offered by the Platform allow you to directly contact the institutions (e.g., parks, municipalities, etc.), public or private organizations (e.g., associations, cooperatives, foundations, companies, etc.), and operators (e.g., guides, professionals, etc.) (hereinafter collectively, the “Participating Organizations”) that promote, organize, and manage the Experiences. In addition to providing you with information, Terre dei Malaspina allows you to book, free of charge or for a fee, your participation in the Experiences offered by the Participating Organizations. Terre dei Malaspina does not organize or manage the Experiences offered by participating Organizations, nor does it act as a travel package organizer. We do not provide transportation or travel; we do not own or participate in any participating Organization, Entity, or Organization of the Experiences offered through the Platform, nor are we financially controlled by any of them.

II. About us

Terre dei Malaspina is a registered trademark owned by Associazione Thara Rothas (“Thara Rothas”), Tax Code and VAT No. 06545680966, with registered office in Milan (MI) – 20154, Via Guercino 6 and operational headquarters in Varzi (PV) – 27057, Via Pietro Mazza 6. Thara Rothas is the owner of the website www.terredeimalaspina.it (the “Platform”). Thara Rothas manages the services and functions of the Platform and administers the activities by providing services to participating Organizations and End Users.
The execution and methods of use of the Experiences (e.g., a hiking or food and wine trail, an educational workshop, etc.) are not the subject of the service offered by the Platform, but rather the content of a contract entered into between you and the participating Organization offering the Experience. We are therefore not responsible for the execution and methods of execution of the Experiences offered to you. Free and/or paid reservations made through the Platform involve the participating Company and you, as the individual making the reservation for purposes not related to your own entrepreneurial, commercial, artisanal, or professional activity (hereinafter the “User”), (the participating Company and the User are hereinafter collectively referred to as the “Parties”). Limited to the issuing of the electronic reservation code and the purchase process, Thara Rothas acts on the specific mandate of the participating Company and on its behalf.

III. These Terms of Use.

These General Terms and Conditions of Contract and Use, together with our data protection policy, govern the use of the services made available through the Platform and represent the fundamental basis of the user relationship between you and the participating Organization regarding the search services and any free or paid booking of the Experiences offered and organized by the participating Organizations.
The terms and conditions of the participating Organizations apply separately and in addition to when you purchase tickets and/or services from them, offered directly on their websites, to which you may be redirected via specific links on the Platform. Terre dei Malaspina has no influence over these terms and conditions.
Terre dei Malaspina does not own, create, control, manage, or provide Experiences. The participating Organizations are solely responsible for the services and Experiences they promote. The contract for the use of the Experience is finalized only with the respective participating Organization. Terre dei Malaspina is not, nor does it become a party to, or otherwise participate in any contractual relationship between you and the participating Organization, nor does it act as an agent in any capacity. The booked Experiences (contract conditions and any regulations) are therefore subject exclusively to the responsibility of the respective participating Organization, with the consequence that any cancellations and/or changes to the booking will also be managed directly by the participating Organizations themselves.

IV. The services offered by Terre dei Malaspina.

Our services are designed to provide you with the information you need to review your Experiences made available on the Platform by participating organizations and to plan your Experience simply and effectively. Specifically, Terre dei Malaspina’s services include:

1. Search engine.

We present you with Locations and Experiences (e.g., hiking trails, food and wine tours, educational workshops, entrance fees, guided tours, festivals, conferences, courses, events, services, etc.) promoted by participating organizations. We determine these based on your geographic location and/or your search filters, providing a detailed representation including various information (e.g., duration, accessibility, booking options, cost, etc.). We cannot guarantee the completeness or accuracy of the results; therefore, we rely on the information made available on the Platform by the participating organizations themselves.

2. Direct interaction with the participating entities.

The Experience pages presented on Terre dei Malaspina may include links that allow you to access the websites of participating organizations and take advantage of the services, including booking, offered by the respective participating organizations. Through this feature, you can interact and engage directly with them, booking your Experience directly with them where possible. If the booking requires payment, this is done through the payment system indicated on their website, under the terms and conditions set forth therein. We do not receive any commission from the participating organizations.

3. Direct bookings on our Platform.

For some Experiences, Terre dei Malaspina offers you the option, directly on the Platform, to: a) book the Experience free of charge (hereinafter “Free Booking”); or, where possible, b) book and also pay for the Experience in advance online (hereinafter “Paid Booking”).
In both cases, your navigation will not be redirected to the websites of the respective participating Experience Providers, but will take place through the Platform.
In accordance with our data protection provisions, when you book an Experience through the Platform, whether paid or free, we collect and share the necessary data (e.g., your name, email, number of participants, etc.) with the respective participating Experience Provider to allow you to enjoy the Experience. To reduce the risk of error, each of your bookings is finalized via confirmation, which you receive via email to the address you provided during the booking process.

3.1 Free Booking:
3.1.1 For some Experiences on the Platform, you can make a free booking by completing the appropriate booking form. To complete the booking form and finalize your booking, you are required to: indicate the number of participants; provide the participants’ information (email address, first name, last name, age, etc.); and confirm that none of the participants are subject to any measures prohibiting their participation.
3.1.2 Before confirming and submitting the form, you can modify/correct the information. Therefore, after carefully reading them, you are required to expressly approve these General Terms and Conditions by checking the appropriate checkbox available on the Platform.
3.1.3 For each booking, you will receive a booking confirmation email at the email address you provided. This email contains:
– an automatically generated electronic booking code or, in other cases, a unique booking code or voucher; Documents you must present at the check-in point (Ticket Office) before the start of the Experience offered by the participating Organization, to physically redeem the valid document for participation (e.g., ticket, etc.);
– Any additional instructions requested by the participating Organization for participation in the Experience.

3.2 Paid Booking:
3.2.1 For some of the Experiences presented on the Platform, you can make a paid booking by completing the appropriate booking and purchase form. To book and purchase the Experience, you are required to: indicate the number of participants; provide the participants’ information (email address, first name, last name, age, etc.); choose from the indicated payment methods; and finally, make the payment to complete the order and finalize your booking.
3.2.2 Before making the payment, you will be shown an order summary, where you can modify/correct the information before submitting it. Therefore, after carefully reading it, you are required to expressly approve these General Terms and Conditions by checking the appropriate box and, finally, by clicking the “Confirm booking with obligation to pay” button, proceed with the payment.
3.2.3 Upon completion of each payment, you will receive a booking confirmation email at the email address you provided. This email contains:
– an automatically generated electronic booking code or, in other cases, a unique booking code or voucher that you must present at the check-in point (Ticket Office) before the start of the Experience offered by the participating Company to physically redeem the valid participation document (e.g., ticket, etc.);
– any further instructions requested by the participating Company for participation in the Experience; as well as
the contact information for the participating Company’s Customer Service department, which you can contact for assistance and/or complaints.
– the order confirmation email, which contains a link to these General Terms and Conditions, constitutes confirmation of the contract concluded on a durable medium pursuant to Article 51, paragraph 7, of the Consumer Code.
3.2.4
We ask you to promptly review any documents sent to you. You are required to immediately report any errors or incorrect information by contacting our Help Center, reachable at the web address: https://www.terredeimalaspina.it/centro-assistenza, following the procedure set out in point V below.

3.3 Payments
3.3.1 Before proceeding with payment, you will be asked to choose your preferred payment method from those available. If you choose immediate payment (at the time of purchase) by credit card, PayPal/Strype, or immediate bank transfer, you are required to provide the relevant data via a secure connection. The reservation is considered accepted only after receiving confirmation of payment. We are appointed and authorized by the participating Organization to collect payments.

3.4 Cancellation of the Experience for reasons not attributable to you – Exclusion of the Right of Withdrawal.
3.4.1 Terre dei Malaspina is not, nor does it become a party to, or otherwise participate in any contractual relationship between you and the participating Organization. Limited to the issuing of the electronic booking code and the purchase process, it acts on the specific mandate of the participating Organization.
3.4.2 In the event of cancellation of an Experience pursuant to art. 3.2 (Paid Booking), for reasons beyond your control (e.g., cancellation of the Experience due to failure to reach the minimum number of participants and/or the participating Organization’s inability to conduct the Experience, force majeure, or measures taken by the competent authorities), Terre dei Malaspina is not responsible for any cancellation of the Experience by the participating Organization.
You will receive a notification email from the participating Organization or, where possible, from assistenza@terredeimalaspina.it containing the measures the participating Organization has taken in relation to the canceled Experience.

3.4.3 Exclusion of the Right of Withdrawal. In accordance with the provisions of contracts for the provision of services relating to leisure activities that the participating Company undertakes to provide on a specific date (pursuant to Article 59, paragraph 1, letter n) of Legislative Decree no. 206 of 6 September 2005, “Consumer Code”), the right of withdrawal provided for by Article 52 of the Consumer Code does not generally apply to the contract and therefore you will not be able to exercise this right in relation to the purchase of your reservation.

IV. Registration

To make a reservation and access the services offered by the Platform, we ask you to register a personal account or share some of your contact information. You will then be able to access your individual profile by entering a valid email address and password. All your personal data is processed in accordance with our Data Protection Policy (https://www.terredeimalaspina.it/privacy-policy/). Only natural persons of legal age and full legal capacity may register as users of our services. It is your responsibility to maintain the confidentiality and security of your Account login credentials and not to disclose them to third parties. Please notify us immediately of any behavior that may create security vulnerabilities or any potential misuse of your account. Terre dei Malaspina cannot be held liable for any damages resulting from unauthorized use of an account. When registering, you are required to provide the required information completely, accurately, and truthfully and, if necessary, to update it. Your registration is non-transferable. Account deactivation due to inactivity: If you do not use the Services for a period of time exceeding 24 consecutive months, Terre dei Malaspina has the right to deactivate your Account and subsequently delete it without providing you with further specific notice.

V. Help Center – Customer Care

To access the Help Center, we ask you to register a personal account, which you can access by entering a valid email address and password. All your personal data is processed in accordance with our Data Protection Policy (https://www.terredeimalaspina.it/privacy-policy/). Only natural persons of legal age and full legal capacity may register as users of our services. It is your responsibility to maintain the confidentiality and security of your account login credentials and not to disclose them to third parties. Please notify us immediately of any behavior that may create security vulnerabilities or any potential misuse of your account. When registering, you are required to provide the required information completely, accurately, and truthfully and, if necessary, to update it. Your registration is non-transferable. Account deactivation due to inactivity: If you do not use the services for a period of more than 24 (twenty-four) consecutive months, Terre dei Malaspina reserves the right to deactivate your account and subsequently delete it without further notice.

VI. Limitations of Platform functionality

We reserve the right to make changes to the content or functionality of the Platform at any time (e.g., through patches, updates, or modifications) and do not guarantee the continuous availability of our pages. In particular, technical problems beyond our control may lead to service interruptions, and maintenance work may affect their availability. These interventions are carried out in the least intrusive manner possible. We continually strive to ensure flawless and uninterrupted technical operation of our services. However, we cannot assume any liability for the timely and uninterrupted accessibility or usability of our offerings.
You are responsible for taking appropriate measures for their use. When using hyperlinks to third parties, Terre dei Malaspina assumes no responsibility for third-party content, nor is it obliged to monitor it.

VII. Obligations and duties of the User, warnings

As a User, you are responsible for complying with all formalities related to the use of the Experience you booked (age requirements, entry regulations, vaccinations, and other health requirements). While we take care to inform you of any warnings known to us, it is your responsibility to take note of the individual regulations of each Location and participating Venues in order to use their services and Experiences.

VIII. Limitation of liability of Terre dei Malaspina

We make every effort to ensure the accuracy of the information contained on all our pages. For details of the Locations, Experiences, or services, we rely on the information provided by the respective participating entities. We are unable to fully verify the accuracy and timeliness of the information we collect and present. We only verify it when necessary. We therefore ask you to personally check your individual access/visit information and, if necessary, report any unlawful and/or incorrect/untrue content to us. The same applies to all other information presented by the participating entities regarding the Experiences. We are not involved in the presentation or description of the visit or excursion services provided by the participating entities and therefore are not responsible for the content offered or the contracts concluded with them. Any warranty claims or claims for damages must be asserted exclusively against the participating entities. Our offer contains links to other websites that we do not operate or directly control and for which we are not responsible. We do not endorse the content of these other websites and assume no responsibility for the legality or functionality of such content, nor are we liable for any loss or damage that may arise from using these pages. We recommend that you carefully read the terms and conditions of the respective websites to which the Platform may link.

IX. Data protection

The processing of your data when using our services is subject to our data protection policy (https://www.terredeimalaspina.it/privacy-policy/).

X. Copyrights

All intellectual property rights to any content on the Terre dei Malaspina website belong to the participating Company or Terre dei Malaspina, unless expressly stated otherwise.
Except for uses necessary for the use of the Platform’s services, you agree not to download, upload, copy, print, reproduce, or use in any way, in whole or in part, the Platform’s content without the written permission of the participating Company or Terre dei Malaspina.

XI. Legge applicabile

These Terms of Use are governed by Italian law and shall be interpreted in accordance with such legislation. Any dispute relating to these Terms and Conditions shall be governed and interpreted in accordance with Italian law, in particular Legislative Decree No. 206 of 6 September 2005, the Consumer Code, with specific reference to the regulations on distance contracts, and Legislative Decree No. 70 of 9 April 2003 on certain aspects of e-commerce.
All disputes relating to these Terms and Conditions shall be subject to the jurisdiction of the Court of the place of domicile or residence of the consumer user, in accordance with the applicable law, or, at the consumer’s discretion, the Court of Milan.
